Cyber Crime / Computer Crime Defense
Cyber Crimes generally includes prohibited acts that 1)
are done to computers or computer devices on the one hand - such as
unauthorized entry, denial of service, or destruction or modification of
data, and 2) offenses that are committed via computers such as fraud
related offenses, phishing and defamation on the other. The former
category is often inappropriately refered to as "hacking."
Under California law computer crime is addressed by
Cal. Penal Code §502, as well as other statutes that
consider crimes in which a computer may
have aided the commision of the primary offensive. Federal law
pertaining to computer crime is for the most part set out in
18 USCS §1030.
